:Just because they're crediting the AP does not mean they bought it. It just means it was a wire photograph. I'd be amazed if any news organization is taking money for this, and I'd say the onus is on you to show that it is, because it's such an unlikely scenario. I've labeled it fair use rather than PD to suit you (it is definitely fair use). I must say I find this fussing about the status of photographs that are everywhere somewhat strange and pointless.
