'''Igor Janev''' (Игор Јанев, born September 29, 1964) is a [[Republic of Macedonia|Macedonian]] diplomat.
==Biography==
Igor Janev was a Special Advisor of the Minister of foreign affairs of the Republic of Macedonia in 2002.<ref>see about his position: http://www.makemigration.com/</ref>Currently, Janev is a full professor (Scientific advisor) of International Law and International relations (political science) at the Institute for political Studies in Belgrade.<ref>under the Serbian Law position of the Scientific advisor at the public institute has a rank of the full professor at the public (state) university</ref> Janev proposed solution of the Macedonian Name issue in the United Nations,which was officially accepted by the Macedonian President George Ivanov in 2012. President Ivanov stated at the 67th Session of the General Assembly of the United Nations that Macedonia was admitted in the UN with additional conditions out of the legal scope of the United Nations Charter<ref>additional conditions: 1) to use denomination the Former Yugoslav Republic of Macedonia (replacing Macedonian Constitutional name) at the UN; 2) to negotiate with another state (Grece) over its Constitutional name. See particulary general conditions of Article 4 of the United Nations Charter.</ref>and contrary to the Advisory Opinion of the International Court of Justice delivered in the 1948. stating that such additional conditions were illegal and that political organs of the UN are not entitled to vote on such conditions.<ref>see Advisory Opinion of the International Court of Justice of 1948. That Advisory Opinion was adopted by the UN General Assembly in 1948, as an interpretation of the article 4 of the UN Charter.</ref>The Government of Republic of Macedonia, thus, officialy supported opinion and the statement of Janev that United Nations in the process of admission of Macedonia to the United Nations had violated United Nations Charter.
Dr. Janev had presented a detailed analysis of the legal aspects of SC Resolution 817 (1993) and GA Resolution 47/225 (1993) which are related to the admission of Macedonia to UN membership. It has been demonstrated that the additional conditions imposed on Macedonia for its admission to the United Nations constitute a clear violation of Articles 4(1), 2(1) and 2(7)of the Charter, and define a discriminatory legal status of the state as a member (again in violation of Article 2(1)). The responsibility of the United Nations Organization for violation of Charter’s provisions derives from the duty of the Organization to respect the basic rights of the states (either as applicants to UN membership, or as UN members), which are protected by the principles of international law enshrined in the articles of the Charter. The character of these violations is of the Ultra - Vires type with respect to the legal norms of the Charter as a multilateral treaty. According to Prof. Janev the violations of Articles 4(1), 2(1) and 2(7) involve the legal personalities of both the Organization and the Macedonian state. This provides a basis for instituting a judicial redress of the legal consequences resulting from the breach of constitutional provisions of the UN Charter. Janev had proposed two possible pathways for such judicial redress, based on the violation of Article 4(1)and Article 2(1), respectively, and on the use of the advisory jurisdiction of International Court of Justice.
